The calendar of the first CfD tender

Following our previous Legal and Tax Alert on the CfD scheme (available here), the Ministry of Energy published the Calendar of the first CfD tender. Find below the main dates on the Calendar: I. The period preceding the submission of the funding application At this stage, the CfD Scheme Operator (Transelectrica SA) receives questions/clarifications/comments from interested parties regarding the tender, topics that will be discussed during the CfD Applicants' Conference, scheduled for October 10, 2024. Interested parties may submit questions or comments to the CfD Scheme Operator via email at Operator.CFD@transelectrica.ro by September 30, 2024. The competent authorities involved will endeavour to respond to requests for clarifications on the tender documents by October 18, 2024. II. Submission of funding applications and evaluation of technical offers Until November 18, 2024, applicants will submit their funding application with all relevant documentation, including the technical and financial offers. The evaluation phase of the technical offers and the appeals against rejection decisions phase will occur between November 20 and December 13. III. Assigning the CfD Agreements On December 16, 2024, the financial offers of the applicants accepted in the previous stage will be evaluated and the winners will be announced on the same day. Then follows a short but intense period between December 17 and December 20, 2024, during which (i) the Order of the Minister of Energy will be issued for granting the State aid to the winners (December 17, 2024); (ii) the winning applicants submit the completed forms (December 18, 2024); the applicants receive the CfD Agreements to countersign (December 20, 2024), with a signing deadline by January 20, 2025.
