As of 7 March 2025, the legal provisions according to which in a medical practice, regardless of the form of organisation, a physician can only hold the capacity as owner/ director or employee or independent natural personal having a contract with the medical practice, have been repealed.
The aforementioned provisions were introduced on 3 February 2025 and generated considerable controversies, since the unclear manner of the regulation could have led to the conclusion that physicians having a company established as per the Companies Law No 31/1990 as a form of organisation could no longer collaborate with other medical practices in this form.
In order to eliminate the ambiguities and controversies, the legal provisions regulating the capacity that a physician may have in a medical practice were repealed as of 7 March 2025, following the entry into force of Government Emergency Ordinance No 8/2025 amending and supplementing Law No 95/2006 on health reform and other health-related legislation.
