The end of 2025 brings a series of legislative amendments of interest for the energy and telecommunications sectors in Romania. Below is a brief overview of the main points of interest in the legislative deeds published in the Official Gazette in the last month of the year:
► Emergency Ordinance No. 80/2025 supplementing Law No. 123/2012 on electricity and natural gas (“GEO No. 80/2025”)
GEO No. 80/2025 aims to develop communications and data transmission services through the existing fiber optic segment in the energy grid. According to the new regulation, Transelectrica will operate the fiber optic network as a priority to ensure the proper functioning of the grid, but also has the right to lease the available capacity to third parties or public authorities.
The operation of the fiber optic network by entities that are not part of the national defense system is subject to their authorization under Law No. 163/2021 on the adoption of measures relating to information and communications infrastructures of national interest and the conditions for the implementation of 5G networks.
► Order No. 70/2025 amending and supplementing the Methodology for determining and collecting the contribution related to contracts for difference (”ANRE Order No. 70/2025”).
According to ANRE Order No. 70/2025, storage facility operators are included on the list of those required to pay the CfD contribution. The obligation applies both to energy consumed from the storage process at their own consumption sites and to energy supplied to consumers connected to the storage battery bars.
► Order No. 79/2025 amending and supplementing ANRE Order No. 53/2024 approving the Methodology for allocating electricity network capacity for connecting electricity generation sites, as well as amending and supplementing certain ANRE orders in the field of connecting users to the public electricity network (”ANRE Order No. 79/2025”)
ANRE Order No. 79/2025 is the normative deed adopting the amendments proposed in the draft Order we wrote about in the past. The article is available here. Compared to the draft Order, the new regulation establishes a different timetable for 2026, as follows:
▸ June 30, 2026 - Transelectrica is required to publish the list of available capacities of the grid;
▸ July 14, 2026 - Users submit applications for capacity allocation;
▸ July 20, 2026 - Distribution operators submit allocation requests to Transelectrica;
▸ July 24, 2026 - Finalization of the list of applications for capacity allocation by Transelectrica;
▸ October 23, 2026 - Completion of the global solution study and publication of the results;
