On 31 March 2025, the provisions of the Decision no. 295/2025 on the General Register of Employees - REGES-ONLINE (the "Decision") entered into force, except for those concerning contraventions and the application of sanctions for violation of the obligations set out in the Decision, which will enter into force 30 days after its publication in the Official Journal.
The Decision introduces significant amendments to the management of employee records by replacing the Revisal application with the new platform - REGES-ONLINE, a system that will operate exclusively online (the "Register"). The main amendments concern, among other matters:
▸The implementation of an online platform for the completion, submission, management, consultation and processing of data relating to the elements of individual employment contracts;
▸Obligation for employers to submit new information on employees to the Register, such as:
- place of work (fixed or mobile); - working time and its distribution (including full-time employees); - for disabled employees, the degree and type of disability and the duration of the certificate of degree and type of disability; - the period, the causes of suspension and the date of termination of the suspension of the individual employment contract, including in cases of suspension due to sick leave, absence without cause and force majeure.
▸Amendment of the amount of certain sanctions applicable to employers for failure to comply with the obligations set out in the Decision.
Employers are obliged to register in the Register within 6 months from the date of entry into force of the Decision. Failure to comply with this obligation constitutes a contravention and is sanctioned with a fine from 15.000 RON to 20.000 RON. After the expiry of the aforementioned 6-month period, Government Decision no. 905/2017 on the general register of employees is repealed
Within the above-mentioned period, the employers are obliged to fill in and submit to the Register all the elements of the individual employment contracts active on that date, which are not included in the REVISAL application. Failure to comply with this obligation constitutes a contravention and is sanctioned with a fine from 5.000 RON to 10.000 RON.
The Procedure for access to complete, submit and query data in/from the Register shall be established by order of the Ministry of Labor, Family, Youth and Social Solidarity, within 30 days from the date of entry into force of the Decision.
